1. Acceptance of these Terms

By accessing or using the website, you acknowledge that you have read and agree to these Terms and the posted Privacy Policy. If you do not agree, do not use the website.

These Terms do not replace a signed advertising insertion order, sponsorship agreement, contributor release, or other written agreement. If a separate written agreement conflicts with these Terms regarding its subject matter, the separate written agreement controls.

2. Website scope

The website provides public information for Hoppy Trails, Hoppy Trails Monthly, the Brewery Directory, Battle of the Stouts, advertising and partnership opportunities, and the planned Hoppy Trails App.

The website may link to official Stripe-hosted checkouts for paid magazine advertisements, 2027 partnerships, and the optional digital Battle Card. The Hoppy Trails site does not collect full payment-card or bank-account credentials itself. Public user accounts and the downloadable Hoppy Trails App are not yet available. Product descriptions, release plans, features, availability, and dates may change before launch.

3. Intended audience and responsible use

Hoppy Trails is a craft-beer travel brand intended for adults of legal drinking age. You are responsible for complying with the laws that apply where you live, travel, purchase, possess, or consume alcoholic beverages.

Hoppy Trails does not sell or serve alcoholic beverages through the Phase 1 website. Hoppy Trails is not a designated-driver, rideshare, taxi, lodging, medical, legal, emergency, or transportation provider. Never drink and drive. Do not rely on the website as a substitute for sober transportation planning, emergency assistance, official road conditions, medical advice, or local law.

4. Informational content; no guarantee of accuracy

Hoppy Trails works to provide useful information, but brewery details, events, hours, menus, addresses, prices, laws, road conditions, lodging, transportation, and third-party availability can change without notice. Verify important information directly with the responsible business or authority before traveling, purchasing, or making plans.

Content is provided for general informational and entertainment purposes. Hoppy Trails does not guarantee that content is complete, current, error-free, suitable for a particular purpose, or available without interruption.

5. Permitted use

You may access and use the website for lawful personal or internal business purposes consistent with these Terms. You may share ordinary links to public pages, provided the link does not falsely suggest sponsorship, endorsement, partnership, or ownership.

6. Prohibited conduct

You may not:

• use the website for unlawful, fraudulent, deceptive, abusive, or harmful activity;
• interfere with security, availability, or operation of the website;
• attempt unauthorized access to systems, accounts, data, or source code;
• introduce malware, automated abuse, excessive requests, scraping that violates applicable restrictions, or other harmful technology;
• copy, reproduce, republish, sell, license, or exploit protected Hoppy Trails content except as authorized by law or written permission;
• remove copyright, trademark, sponsorship, advertising, safety, or attribution notices;
• falsely imply affiliation with or endorsement by Hoppy Trails;
• impersonate another person or misrepresent authority to act for a business;
• submit content that is unlawful, infringing, defamatory, misleading, discriminatory, obscene, or unsafe; or
• use Hoppy Trails content to encourage underage drinking, excessive consumption, drinking and driving, or other unsafe conduct.

7. Intellectual property

The website and its original text, design, graphics, logos, trademarks, photographs, layouts, compilations, and other content are owned by Hoppy Trails or used with permission and are protected by applicable intellectual-property laws.

"Hoppy Trails," Hoppy Trails Monthly, associated logos, slogans, and product names may be trademarks or service marks of Hoppy Trails LLC. No license is granted except the limited right to access the public website under these Terms.

Third-party names, logos, and materials remain the property of their respective owners. Their appearance does not necessarily imply endorsement or affiliation.

8. Materials sent to Hoppy Trails

Do not send confidential, proprietary, or sensitive information unless Hoppy Trails has agreed in writing to receive it under appropriate terms.

Advertising artwork, photographs, trademarks, copy, interviews, and other materials are governed by the applicable insertion order, permission, release, or written agreement. Sending material alone does not guarantee publication, confidentiality, payment, editorial coverage, or acceptance.

9. Advertising and editorial independence

Paid advertising, sponsored features, and paid partnerships are labeled so readers can distinguish them from independent editorial content. Free editorial consideration does not require payment and does not promise selection. Purchasing advertising does not guarantee editorial coverage, favorable treatment, audience size, impressions, clicks, scans, reservations, sales, downloads, or return on investment.

A paid checkout submits a placement or partnership request that remains subject to Hoppy Trails availability and content approval. If Hoppy Trails cannot approve or fulfill a paid request, Hoppy Trails will refund the payment to the original payment method. Additional advertising terms may appear in the applicable insertion order or written agreement.

10. Payment security and Stripe

Valid Hoppy Trails payment instructions are delivered through an official Hoppy Trails Stripe checkout linked from hoppytrailsapp.com, an authorized Hoppy Trails email, or an official Stripe invoice associated with hoppytrails25@gmail.com. Hoppy Trails will not request gift cards, account passwords, credentials, or verification codes as payment.

One-issue advertisements and 2027 sponsorship packages are one-time payments. A monthly placement renews monthly until canceled. Cancellation prevents future renewals but does not ordinarily refund a placement period that has already begun, subject to applicable law and Hoppy Trails fulfillment obligations.

Stripe processes payments under its own terms and privacy practices. Hoppy Trails is not responsible for Stripe's independent systems or policies, but Hoppy Trails remains responsible for its own commitments to the purchaser.

11. Third-party links and services

The website may link to breweries, maps, lodging, transportation, event, payment, social-media, or other third-party services. Links are provided for convenience and do not guarantee endorsement, safety, availability, legality, accuracy, or performance.

Your use of a third-party service is governed by that party's terms and policies. Hoppy Trails is not responsible for third-party acts, omissions, content, transactions, security, or availability.

12. Availability and changes

Hoppy Trails may update, suspend, restrict, or discontinue any part of the Phase 1 website, correct errors, or change pre-launch plans without liability, subject to any separate written agreement. Hoppy Trails does not promise a specific release date for an unfinished product unless that promise appears in a separately signed agreement.

13. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." HOPPY TRAILS DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOPPY TRAILS AND ITS OWNER, CONTRACTORS, CONTRIBUTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, TRAVEL COSTS, BUSINESS OPPORTUNITIES, OR OTHER LOSSES ARISING FROM OR RELATED TO THE WEBSITE OR THIRD-PARTY SERVICES.

Nothing in these Terms excludes liability that cannot lawfully be excluded. No additional direct-damages cap is included in this owner-approved Phase 1 version.

15. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Hoppy Trails and its owner, contractors, and representatives from claims, losses, liabilities, costs, and reasonable professional fees arising from your unlawful use of the website, violation of these Terms, infringement of another party's rights, or materials you submit without required authority.

This section is included in the owner-approved Phase 1 version and remains subject to rights that cannot lawfully be waived.

16. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules, except where applicable law requires otherwise.

No mandatory arbitration, class-action waiver, or exclusive forum is included in this owner-approved Phase 1 version.

17. Changes to these Terms

Hoppy Trails may update these Terms by posting a revised version with a new effective date. Changes apply prospectively unless applicable law or a separate agreement provides otherwise. Material changes may require additional notice or consent.

18. Severability; no waiver; assignment

If a provision is found unenforceable, the remaining provisions remain in effect to the extent permitted by law. A failure to enforce a provision is not a waiver. You may not assign rights or obligations under these Terms without Hoppy Trails's written consent. Hoppy Trails may assign these Terms in connection with a business transfer, subject to applicable law.

19. Entire agreement

These Terms and the posted Privacy Policy are the entire agreement concerning general use of the Phase 1 website. A signed insertion order or other written agreement controls its specific subject matter.
